Terms of Service

By using the Neyersin service, you are deemed to accept the terms below. Please read carefully before signing up. If you do not accept the terms, you may not use the service.

1. Parties and Definitions

• Neyersin: Bilgekaan Yılmaz (natural person), service provider
• User / Tenant: a restaurant operator who creates a Neyersin account (in the owner, manager, or staff role)
• Guest: an end-user who views the menu by scanning a QR code
• Content: menu, product images, prices, theme, and text data uploaded by the Tenant
• Service: the QR menu, dashboard, Discover (Keşfet) listing, and all related features provided by Neyersin

2. Account Creation

• The person creating the account must be over 18 years old and authorized to represent the business that uses Neyersin
• Must provide accurate, current, and complete information in the registration form
• The confidentiality of the password is the user's responsibility; suspicious access must be immediately reported to Neyersin
• Multiple users (owner/manager/staff) can be defined under a single tenant — authorization is the owner's responsibility

3. Subscription Tiers

3.1 Free Trial (14 Days)

• Newly registered tenants can use Pro features free for 14 days
• If no payment is made at the end of the trial, the account is downgraded to "free"; some features become unavailable
• Menu and data added during the free period are preserved and not deleted

3.2 Pro and Business Plans

• Subscription-based plans; billed monthly or annually
• Pricing is published on Neyersin's Pricing page and kept current; changes are notified by email at least 30 days in advance
• VAT-inclusive / -exclusive display complies with Turkish legislation
• Invoices are sent to the email address registered with Neyersin

3.3 Cancellation and Refund

• Users can cancel their subscription anytime via the dashboard
• Monthly subscriptions remain active until the end of the current billing period; no refund is provided
• Annual subscriptions are fully refundable within the first 14 days under the right-of-withdrawal; afterwards, refund requests are evaluated proportionally
• The "distance sales" provisions of Turkish Consumer Law No. 6502 apply

4. Acceptable Use

The following behaviors are prohibited when using Neyersin:

• Publishing illegal content (intellectual property violations, misleading pricing, prohibited products)
• Spam, phishing, distribution of malicious software
• Attempting to bypass system security, evade rate limiting, DDoS attempts
• Unauthorized access to others' accounts or impersonation
• Automating the Neyersin API for commercial scraping or data collection
• Misleading guests via QR menu (fake payment pages, etc.)

If these rules are violated, Neyersin reserves the right to suspend or terminate the account without prior notice. No refund is issued in cases of serious violation.

5. Content Ownership and License

• All Content you upload remains your property
• You grant Neyersin a license to store, process, display, and optimize the Content solely to provide the service
• By accepting visibility on the Discover (Keşfet) page (default: accepted), your restaurant profile and product images may be listed on Neyersin catalog pages
• You can opt out of Discover via dashboard > Settings

6. Service Availability (SLA)

• Neyersin targets 99.5% monthly service availability
• Scheduled maintenance is announced by email at least 24 hours in advance
• Availability is measured excluding: major incidents (force majeure), ISP/infrastructure failures, issues caused by the tenant (quota exceeded, blocked account)
• In case of serious breach, proportional refund may be considered

7. Limitation of Liability

To the maximum extent permitted by applicable law, Neyersin shall not be liable for indirect damages (loss of profit, data loss, reputational damage). Total liability for direct damages is limited to the subscription fees paid in the 12 months preceding the event.

The service is provided "as-is"; no explicit or implied warranty is given that it will operate uninterrupted or error-free. This means it is important to maintain alternative plans when relying on Neyersin for critical business processes.

8. Termination

• Users may close their account at any time via the dashboard
• Neyersin may terminate accounts in violation of these terms with 14 days' notice
• In case of security threat or legal obligation, the notice period may be shortened
• Following termination, data is deleted in accordance with KVKK retention periods; data export remains available for 30 days

9. Changes

When these terms change, notification is sent to your registered email address. For significant changes, you are notified at least 30 days before the changes take effect. Continuing to use the service after changes constitutes acceptance of the new terms.

10. Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of Türkiye. The Istanbul (Çağlayan) Courts and Enforcement Offices have jurisdiction over disputes between the parties. The consumer arbitration committee / consumer court rights of users qualifying as consumers under Law No. 6502 are reserved.
